Terms of Service LeadScout

Version 3.4Effective from 15 Oct 2026Digital service · B2B and consumers

Terms for electronic services provided through leadscout.pl and the LeadScout extension for Chrome. Consumers: the key information on Subscription renewals, the right of withdrawal and complaints is in § 4, § 5 and § 8.

English translation. This is a translation of the Polish “Regulamin świadczenia usług LeadScout” provided for convenience. The contract is concluded in Polish and, in case of any discrepancy, the Polish version prevails — without prejudice to mandatory consumer protection rules of the country where a Consumer has their habitual residence.

§ 1General provisions and Service Provider details

  1. These terms (the “Terms”) are the terms referred to in Article 8(1)(1) of the Polish Act of 18 July 2002 on the provision of electronic services and set out the types, scope and conditions of providing the Services electronically, the conditions for concluding and terminating contracts for the Services, the complaints procedure, and the rights and obligations of the Service Provider and the Users.
  2. The Service Provider is , a natural person conducting unregistered business activity (działalność nierejestrowana) within the meaning of Article 5(1) of the Polish Act of 6 March 2018 — Entrepreneurs’ Law, under the name “LeadScout”, correspondence address: , email: kontakt@leadscout.pl (the “Service Provider”). The Service Provider is not entered in the Polish business register (CEIDG); once the business is registered, its registration details (NIP, REGON) will be stated in these Terms.
  3. You can contact the Service Provider: (a) by email at kontakt@leadscout.pl, (b) via the contact form on leadscout.pl, (c) by post to the address in section 2. The Service Provider does not operate a telephone helpline.
  4. The Terms are available free of charge at leadscout.pl/en/terms.html in a form that allows them to be obtained, reproduced, recorded and printed (the “PDF / print” function). Before concluding a contract, the User must read and accept the Terms.
  5. The Privacy Policy, which sets out the rules for processing personal data, forms an integral part of the Terms.

§ 2Definitions

The terms used in these Terms mean:

  1. Service — the digital service provided by the Service Provider under the name LeadScout, comprising: (a) the Extension, (b) the Dashboard, (c) the Account, (d) the analysis of Target Websites using artificial intelligence models (e) the contact form, (f) Mail and (g) the CRM.
  2. Extension — software in the form of a web-browser extension for Chromium-based browsers, made available via the Chrome Web Store.
  3. Dashboard — the part of the leadscout.pl website available after signing in, used to manage the Account, Extension settings, Analysis history and the Subscription.
  4. Account — the set of resources and settings assigned to a User in the Service Provider's IT system, identified by an email address and protected by a password, or accessed by signing in with a Google or Microsoft account.
  5. Mail — the Dashboard feature for connecting a Mailbox and preparing, editing, scheduling and sending emails from it, in particular the messages suggested in Reports.
  6. CRM — the Dashboard feature for assigning sales stages, tags and lists to leads (companies in the Analysis history) and adding notes and tasks with a due date and an optional reminder sent to the Account email address.
  7. Mailbox — the User's email account with Microsoft 365 or Outlook.com, or with another provider supporting the SMTP and IMAP protocols (e.g. Gmail, Zoho, iCloud, Yahoo, OVHcloud or a hosting provider's mail server), that the User has connected to the Service by granting it permission to send messages on their behalf.
  8. Target Website — a third party's website selected by the User for Analysis.
  9. Analysis — a single processing of the content of a Target Website (together with automatically fetched subpages of the same website) resulting in a Report; one Analysis reduces the Quota by one.
  10. Report — the result of an Analysis, including in particular the Lead Score, contact and registry data read from the Target Website's code, and content generated by an artificial intelligence model (e.g. suggested messages).
  11. Plan — a variant of the Service (FREE, LIGHT, PRO or ULTRA) defining the Quota and the scope of available features, as described in the Price List.
  12. Quota — the maximum number of Analyses available under a Plan in a given month: on a monthly Subscription — in the Billing Period; on a yearly Subscription — in each consecutive month counted from the day the Subscription is activated.
  13. Top-up — a one-off paid pool of additional Analyses (on the effective date of these Terms — 100 Analyses) added to the Account on top of the Quota, as set out in § 4.
  14. Subscription — a contract for the paid provision of the Service under a paid Plan, concluded for an indefinite period and billed in Billing Periods.
  15. Billing Period — a period of one month (monthly Subscription) or one year (yearly Subscription) counted from the day the Subscription is activated (and for the FREE Plan — the period shown in the Dashboard).
  16. Price List — the current list of Plans and prices published on leadscout.pl in the “Pricing” section and in the Dashboard.
  17. User — a natural person with full legal capacity (in any case at least 18 years old), a legal person or an organisational unit without legal personality granted legal capacity by law, using the Service.
  18. Consumer — a User who is a natural person entering into a legal transaction with the Service Provider not directly related to their business or professional activity (Article 221 of the Polish Civil Code).
  19. Sole Trader with Consumer Rights — a User who is a natural person concluding a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for that person, in particular in view of the subject of their business activity as disclosed in the Polish business register (CEIDG).
  20. Business — a User who is neither a Consumer nor a Sole Trader with Consumer Rights.
  21. Payment Operator — Stripe Payments Europe, Limited, Dublin (Ireland), and companies of its group, handling payments within the Service.

§ 3Types and scope of the Service, technical requirements, licence

  1. As part of the Service, the Service Provider enables the User in particular to: (a) create and maintain an Account; (b) run Analyses of Target Websites selected by the User, including several open browser tabs at once (batch scan); (c) view, export (CSV) and delete the Analysis history; (d) configure Extension settings (including the offer description, ideal customer profile, disqualifiers, language, tone and Report modules); (e) on the ULTRA Plan — send Reports to the User's external system via a webhook URL; (f) use the contact form; (g) sign in to the Account with a Google or Microsoft account; (h) use Mail; (i) use the CRM.
  2. The Extension reads the content of a Target Website only following an explicit action of the User (clicking the scan button, using the keyboard shortcut, choosing the context-menu command or — if the User enables this option — opening the Extension panel with automatic scanning switched on). The Extension does not monitor browsing history.
  3. To use the Service you need: (a) a device with Internet access; (b) Google Chrome version 116 or later, or another Chromium-based browser supporting Manifest V3 extensions; (c) JavaScript enabled; (d) an active email account. The Dashboard works in current versions of popular web browsers.
  4. Specific risks related to using electronic services (Article 6(1) of the Polish Act on the provision of electronic services) include in particular: interception of login data (phishing), malware, unauthorised access to the User's device and spam. The Service Provider never asks for your password by email or phone. Users should use up-to-date antivirus software, a strong and unique password, and sign out of shared devices.
  5. The Service Provider grants the User a non-exclusive, non-transferable, non-assignable and non-sublicensable licence to use the Extension and the Dashboard worldwide, for the term of the contract, solely to the extent necessary to use the Service as intended and in accordance with the Terms. All economic copyrights and other intellectual property rights in the Service, including its code, interface, databases, system instructions (prompts) and the “LeadScout” name, belong to the Service Provider or its licensors.
  6. In particular, it is prohibited to: (a) decompile, disassemble, reverse-engineer or otherwise reconstruct the source code of the Service, except where permitted by mandatory law; (b) share the Account or login data with third parties; (c) use the Service by means of scripts, bots or other automated tools bypassing the Service interface; (d) take actions aimed at circumventing the Quota or the Service's security measures; (e) supply unlawful content through the Service (Article 8(3)(2)(b) of the Polish Act on the provision of electronic services); (f) resell the Service or Reports as a separate service without the Service Provider's written consent.
  7. The Service Provider does not transfer to the User any rights to content generated by an artificial intelligence model, as such content is, as a rule, not a work within the meaning of copyright law. To the extent Reports are protected, the Service Provider grants the User a free licence, unlimited in time and territory, to use them in all fields of exploitation, including for commercial purposes, and undertakes not to exercise moral rights against the User.
  8. Report content is generated automatically by an artificial intelligence model. When passing it on, the User should take into account any disclosure obligations regarding AI-generated content that apply to them under the applicable law.
  9. Mail. A Mailbox is connected in its provider's (Microsoft's) sign-in window, where the User grants the Service the permissions “Send mail as you” (Mail.Send), “Sign you in and read your profile” (User.Read) and “Maintain access” (offline_access). The Service does not get access to the content of the User's messages, contacts or calendar. If the User turns on “Reply tracking”, they additionally grant the permission “Read user basic mail” (Mail.ReadBasic) — the Service then reads only message metadata (sender, subject, date and thread ID), never the content or attachments, to stop sequences automatically after the recipient replies and to detect undelivered messages. Messages are sent from the Mailbox address through the provider's infrastructure, and copies are saved in the Mailbox's sent items folder.
  10. SMTP/IMAP mailboxes. The User connects another provider's Mailbox by entering the server address and the Mailbox password or — where the provider offers it (e.g. Gmail, iCloud, Yahoo, Zoho) — an app password, which the User can revoke at any time in their account settings with the provider. The password is stored only in encrypted form and used only to: (a) send messages through the provider's SMTP server; (b) save a copy of each sent message in the sent folder, if the User chooses so; (c) if the User enters an IMAP server — read the headers of new messages in the inbox (sender, subject, date, thread identifiers) to detect replies, auto-replies and non-delivery; message content is read only for automatic non-delivery reports, to the extent needed to identify which message they concern. The Service does not mark messages as read, move or delete them. Disconnecting the Mailbox in the Client Panel deletes the password. Unless the User turns off the unsubscribe link, the Service adds List-Unsubscribe headers allowing one-click opt-out. The Service Provider is not responsible for limits, spam filters or blocks imposed by the Mailbox provider.
  11. A/B tests and rotation. The User may enter a second subject line — the Service assigns the variants alternately and shows their results in the statistics. When sending many messages, the User may spread them across their active Mailboxes (rotation); each Mailbox keeps its own daily limit and spacing between messages.
  12. Prospecting. (a) List scan — the User may submit a list of company website addresses; the Service then fetches, server-side, the publicly available home page and up to four subpages of each company (e.g. contact, about, team, careers) and runs an Analysis for each company, which uses the Plan quota exactly like an Analysis run in the Extension. (b) Decision makers' e-mails — the Service suggests likely e-mail addresses of a person named by the User, based on the company's address pattern, and checks in DNS whether the domain accepts mail; it sends no test messages and does not guarantee that an address exists. (c) Similar companies — suggestions are generated by an AI model and the Service checks that their websites work; suggestions may be incomplete or inaccurate. (d) LinkedIn — on a company page on LinkedIn the Extension, only when the User clicks “Scan”, reads the company data visible on that page (name, website, industry, size, headquarters, description) and passes it to the Analysis; it does not read personal profiles or messages. The User uses this function in line with LinkedIn's terms. The User is responsible for the legal basis for processing the data of people whose addresses they look up and for contacting them.
  13. CRM and reminders. The User may assign stages to leads (e.g. “new”, “contacted”, “replied”, “meeting”, “offer”, “won”, “lost”), tags and lists, and add notes and tasks. The Service may automatically move a lead to “contacted” after the first message is sent via Mail and to “replied” when a reply is detected — never to a stage earlier than the one already set. If the User sets a due date for a task and leaves the reminder on, the Service sends a one-off reminder to the Account email address once the due date has passed (with a delay that usually does not exceed several dozen minutes). Reminders are an aid only — the Service Provider is not liable for the consequences of their delay or non-delivery. Deleting a lead from the Analysis history deletes the CRM data assigned to it; tasks not linked to a lead remain until deleted. The User enters the content of notes and is responsible for it, including any third-party personal data placed in them (§ 9).
  14. The User may disconnect a Mailbox at any time in the Dashboard (Mail → “Disconnect”) and revoke the Service's permissions in their account settings with the Mailbox provider. The number of Mailboxes that can be connected depends on the Plan: FREE and LIGHT — 1, PRO — 3, ULTRA — 5.
  15. The Service sends messages one at a time, keeping a minimum interval between them and a daily message limit for each Mailbox set by the User within the bounds set by the Service Provider (on the effective date of these Terms — up to 150 messages per day per Mailbox). Messages above the limit wait to be sent on the next day. The Service adds the signature configured by the User and — unless the User switches it off — a link allowing the recipient to opt out of further messages from the User; addresses of recipients who have opted out are automatically excluded from further sending from the User's Account.
  16. The Service Provider exercises due care to hand scheduled messages over to the Mailbox provider at the scheduled time, but does not guarantee delivery and is not liable for messages being rejected, delayed or classified as unwanted by the Mailbox provider or the recipient's server, or for restrictions imposed by the Mailbox provider. Use of the Mailbox is also subject to the terms of the User's agreement with its provider.

§ 4Account, conclusion of the contract, Plans, payments and renewals

Account and the contract for the FREE Plan

  1. The contract for the Service on the FREE Plan is concluded for an indefinite period when the Account is created, i.e. when the registration form (email address and password) is completed, the Terms are accepted and the email address is confirmed via the link sent. The FREE Plan is free of charge and includes the Quota stated in the Price List (on the effective date of these Terms — 10 Analyses per Billing Period).
  2. A User may hold one Account. An Account is assigned to one person and may not be shared.

Subscription (paid Plans)

  1. The Subscription contract is concluded when the first payment for the selected Plan is successfully made via the Payment Operator, after the Terms have been accepted. The Service Provider confirms the conclusion of the contract on a durable medium by sending a payment confirmation with a link to these Terms to the User's email address.
  2. Plan prices are stated in the Price List and are gross prices, i.e. they include VAT where the Service Provider is liable for it. The price in the currency applicable to the User (e.g. PLN or EUR) is shown before payment on the Payment Operator's page. The price does not include any Internet access costs, which the User bears according to their provider's tariff.
  3. Before paying, the User chooses a monthly or yearly Subscription. The yearly price stated in the Price List is lower than twelve times the monthly price and is charged in advance for the whole year. On a yearly Subscription the Quota renews every month, counted from the day the Subscription is activated. The Payment Operator reminds the User by email of an upcoming yearly renewal before the fee for the next year is charged.
  4. The Subscription is concluded for an indefinite period and renews automatically for further Billing Periods until cancelled. The fee for each Billing Period is charged in advance, at its start, using the payment method provided by the User. By concluding the Subscription, the User authorises the Payment Operator to charge that payment method in subsequent Billing Periods.
  5. The Quota renews at the start of each Billing Period (on a yearly Subscription — every month). Unused Quota Analyses do not roll over to the next month and cannot be exchanged for money. An Analysis that did not produce a Report for technical reasons on the Service's side does not reduce the Quota.
  6. The User may cancel the Subscription at any time in the Dashboard (Subscription → “Manage in the Stripe portal”). Cancellation takes effect at the end of the current, paid Billing Period — until then the User keeps access to the Plan, after which the Account moves to the FREE Plan. Cancelling the Subscription does not delete the Account.
  7. Plan changes during the Subscription are made in the Payment Operator's portal. When moving to a higher Plan, the Payment Operator settles the price difference proportionally to the remaining part of the Billing Period; when moving to a lower Plan, the change may take effect from the next Billing Period — in every case the User sees the terms and the amount before confirming the change.
  8. The sales document (invoice or receipt, depending on the Service Provider's tax status) is issued electronically and made available in the Dashboard and in the Payment Operator's portal, which the User agrees to. A User who is a Business may enter invoicing details (including a VAT number) in the Payment Operator's portal or at checkout.
  9. If a payment fails, the Payment Operator may retry the charge. If the payment is not settled within the period stated in the notification, the Subscription may be suspended or terminated and the Account moved to the FREE Plan.
  10. Subject to § 5 and § 7, the fee for a Billing Period that has started (including a started year of a yearly Subscription) is not refunded if the Subscription is cancelled before it ends.
  11. Price changes do not apply to the current, paid Billing Period. The Service Provider informs Users with an active Subscription of a price increase by email at least 30 days before it takes effect; a User who does not accept the new price may cancel the Subscription before that date at no additional cost.

Top-ups

  1. A User with an Account, on any Plan, may buy a Top-up in the Dashboard at the price stated in the Price List (on the effective date of these Terms — EUR 12, or PLN 49 in the Polish version of the website, for 100 Analyses). The Top-up contract is a one-off contract — it does not renew and is not a Subscription. It is concluded when the payment is successfully made via the Payment Operator after the Terms have been accepted; the Service Provider confirms it on a durable medium.
  2. Top-up Analyses are added to the Account promptly once the payment is received. They are used only after the Quota for the given month has been used up, do not expire at the end of a month or Billing Period and remain available after a Plan change or Subscription cancellation until used or until the Account is deleted. They cannot be exchanged for money or transferred to another Account. A Top-up Analysis that did not produce a Report for technical reasons on the Service's side is returned to the Top-up pool.

§ 5Right of withdrawal

  1. A Consumer and a Sole Trader with Consumer Rights may withdraw from a Subscription or Top-up contract concluded at a distance, without giving reasons and without incurring costs other than those set out in section 4, within 14 days of its conclusion (Articles 27 and 28(4) of the Polish Consumer Rights Act of 30 May 2014).
  2. To exercise the right of withdrawal, send the Service Provider an unequivocal statement of withdrawal, in particular by email to kontakt@leadscout.pl or by post to the address in § 1(2). You may use the model form in Annex 1, but this is not mandatory. To meet the deadline, it is enough to send the statement before it expires. The Service Provider will promptly confirm receipt of the statement to the User's email address.
  3. Within the Subscription or a Top-up, the Service starts before the withdrawal period ends only at the express request of the Consumer or Sole Trader with Consumer Rights, made before payment by ticking the relevant statement in the Dashboard. By making the request, the User acknowledges that if they withdraw from the contract, they will have to pay for the service provided up to the moment of withdrawal.
  4. If the User withdraws after making the request referred to in section 3, they must pay for the service provided up to the moment of withdrawal (Article 35(1) of the Consumer Rights Act). The amount is calculated proportionally to the service provided — as the product of the price paid and the ratio of the number of Analyses run up to withdrawal to the number of Analyses covered by the contract (monthly Subscription — the Quota; yearly Subscription — twelve times the Quota; Top-up — the number of Top-up Analyses), and it may not exceed the price paid. Examples: on the PRO Plan (EUR 19 a month, Quota of 200 Analyses), after using 20 Analyses the amount due is EUR 1.90 and EUR 17.10 is refunded; for a Top-up (EUR 12, 100 Analyses), after using 10 Top-up Analyses the amount due is EUR 1.20 and EUR 10.80 is refunded.
  5. The right of withdrawal does not apply if the Service Provider has fully performed the Service with the express prior consent of the Consumer (or Sole Trader with Consumer Rights), who was informed before the start of performance that they would lose the right of withdrawal once the Service Provider had performed the service, and acknowledged this (Article 38(1)(1) of the Consumer Rights Act). For the purposes of this section, the Service is deemed fully performed once all Analyses covered by the contract have been used (monthly Subscription — the entire Quota in a given Billing Period; Top-up — all Top-up Analyses).
  6. The Service Provider refunds all payments received, less the amount referred to in section 4, without undue delay and no later than 14 days from receiving the statement of withdrawal, using the same payment method as the User, unless the User has expressly agreed to another method that involves no costs for them. Upon withdrawal, the Account moves to the FREE Plan.
  7. Withdrawal from the Subscription contract does not affect the contract for the Service on the FREE Plan, which the User may terminate in accordance with § 10.
  8. The right of withdrawal under this section does not apply to Businesses.

§ 6User obligations and rules for using Reports

  1. The User undertakes to: (a) provide a genuine email address and keep it up to date; (b) keep login data confidential and promptly notify the Service Provider if it is disclosed; (c) use the Service in accordance with the law, the Terms and good practice, respecting the rights of third parties.
  2. The User is solely responsible for how Reports are used, including third parties' contact details, in particular for:
    1. having a legal basis for processing the personal data of persons whose data appears in a Report and fulfilling the information obligation towards them under Article 14 GDPR — to this extent the User is the controller and the Service Provider processes the data on the User's behalf under § 9;
    2. complying with the rules on unsolicited commercial communications and direct marketing applicable to them — in Poland in particular Article 398 of the Electronic Communications Law of 12 July 2024, which makes sending commercial information by electronic means (including email) and using telecommunications terminal equipment for direct marketing conditional on the prior consent of the subscriber or end user — as well as unfair competition laws and equivalent rules in other countries (e.g. national ePrivacy laws);
    3. complying with the terms of the services through which they send messages (e.g. email providers and social networks).
  3. The Service is designed to prepare a first business contact. Before sending any message, the User should check that they have a legal basis to do so and critically verify the content of the Report (§ 7(4)).
  4. The User may not use the Service to analyse websites whose content is available only after signing in or is protected by technical measures, or to collect data in a way that infringes the rights of third parties or the terms of Target Websites.
  5. The User is responsible for the content entered into the Service (in particular the offer description, ICP, disqualifiers and Deep Scan questions) and declares that it does not infringe third-party rights or the law.
  6. A User using the webhook feature is responsible for the security and lawfulness of the system to which they send Reports.
  7. When using Mail, the User is the sender of the messages and the controller of the recipients' data. In particular, the User: (a) sends commercial communications by electronic means only where they have a legal basis to do so, including the consent required by Article 398 of the Polish Electronic Communications Law and, for recipients in other countries, in accordance with the law of those countries; (b) does not send bulk messages, unsolicited spam or messages to addresses obtained from purchased or shared databases; (c) does not impersonate others, conceal their identity or mislead recipients about the sender, subject or purpose of a message; (d) gives recipients a simple way to opt out of further messages and promptly respects it, including when the recipient opts out by replying; (e) informs recipients about the processing of their data in accordance with Article 14 GDPR; (f) complies with the Mailbox provider's terms of use.
  8. The Service Provider may suspend sending from the Account or block the use of Mail if it receives justified complaints from recipients or information from the Mailbox provider about a breach of its rules, or finds that sending breaches paragraph 7, in the manner and with the rights set out in § 10(3). Blocking Mail does not affect access to the other features of the Service unless the breach is gross.

§ 7Conformity of the Service with the contract and liability

  1. The Service Provider must supply a Service that conforms to the contract. For Consumers and Sole Traders with Consumer Rights, the Service Provider's liability for lack of conformity is governed by Chapter 5b of the Polish Consumer Rights Act; in the event of non-conformity, the User may demand that the Service be brought into conformity and, in the cases set out in the Act, declare a price reduction or withdrawal from the contract.
  2. The Service Provider takes due care to keep the Service continuously available. The Service Provider may temporarily restrict access to the Service for maintenance, updates or to fix failures — where possible during off-peak hours and with prior notice to Users. The Service relies on third-party infrastructure (§ 6 of the Privacy Policy); outages there may affect the Service's availability.
  3. The contact and registry data in a Report are read directly from the Target Website's code by a deterministic algorithm, not generated by an artificial intelligence model. Their accuracy depends on the data published by the third party; the Service Provider does not guarantee that this data is current or complete.
  4. The other elements of a Report (in particular the Lead Score, relationship assessment, description of needs and suggested messages) are generated by a probabilistic language model and may contain inaccuracies, wrong conclusions or information not supported by the content of the Target Website. They are for support only, do not constitute legal, financial or business advice and must be verified by the User before use.
  5. Towards Businesses: (a) the Service Provider's liability for non-performance or improper performance of the contract is limited to actual loss and to the fees paid by the Business in the 12 months preceding the event causing the loss, and for the FREE Plan — to PLN 100; (b) the Service Provider is not liable for lost profits, loss of data for which the Business did not keep a backup (e.g. a CSV export), or the consequences of using Reports in communication with third parties; (c) statutory warranty (rękojmia) is excluded.
  6. The limitations in section 5 do not apply to damage caused intentionally and do not apply to Consumers and Sole Traders with Consumer Rights to the extent they would conflict with mandatory law.
  7. A User who is a Business shall indemnify the Service Provider and cover reasonable costs if a third party brings claims against the Service Provider arising from that User's use of the Service or Reports in breach of the law or the Terms.

§ 8Complaints and out-of-court dispute resolution

  1. Complaints about the Service, including incorrect Quota or fee calculation, can be submitted by email to kontakt@leadscout.pl or by post to the address in § 1(2).
  2. A complaint should include at least: the Account email address, a description of the issue, the date it occurred and the User's request. If a complaint lacks the information needed to handle it, the Service Provider will ask for it to be completed.
  3. The Service Provider handles the complaint and replies within 14 days of receiving it, to the User's email address or another address they indicate. If the Service Provider does not reply to a complaint of a Consumer or Sole Trader with Consumer Rights within that period, the complaint is deemed accepted (Article 7a of the Consumer Rights Act).
  4. If a complaint is upheld, the Service Provider — depending on its subject and the User's request — brings the Service into conformity, restores Analyses to the Quota, reduces the price or refunds the relevant part of the fee.
  5. A Consumer may use out-of-court complaint and redress procedures, in particular: (a) apply to a permanent consumer arbitration court at the Provincial Inspectorate of Trade Inspection (Poland); (b) apply to the provincial inspector of Trade Inspection to initiate mediation; (c) use the free help of a district (municipal) consumer ombudsman or a consumer organisation. Information about these procedures is available at polubowne.uokik.gov.pl. Consumers resident in other EU countries may also contact their national consumer centre (ECC-Net). These procedures are voluntary and require the consent of both parties.

§ 9Entrustment of personal data processing

  1. With regard to third parties' personal data contained on Target Websites and in Reports (e.g. names, job titles, business email addresses and phone numbers), the controller is the User, who decides to select a Target Website for Analysis and how the Report is used further. The User entrusts the Service Provider with processing this data on the User's behalf under Article 28 GDPR, and this section constitutes a data processing agreement. This does not apply to a User using the Service for purely personal or household purposes.
  2. The entrustment covers ordinary data, publicly available on Target Websites, relating to representatives, employees and associates of third parties. The sole purpose of processing is to provide the Service (running Analyses, storing the Analysis history, exporting and sending Reports on the User's instruction), and the processing period corresponds to the period for which the Analysis history is stored on the Account. For Mail, the entrustment also covers recipients' email addresses and names, the content and status of messages in the Outbox and information that a recipient has opted out of further messages; the purpose is to prepare, schedule and send messages on the User's instruction and to keep the opt-out list, and the processing period lasts until the data is deleted by the User or the Account is deleted.
  3. The Service Provider: (a) processes data only on the User's documented instructions, which include using the Service's features; (b) ensures that persons authorised to process the data have committed to confidentiality; (c) applies the technical and organisational measures referred to in Article 32 GDPR, described in the Privacy Policy; (d) assists the User, where possible, in fulfilling data subjects' rights and the obligations under Articles 32–36 GDPR; (e) deletes the data after the end of the Service unless the law requires further storage; (f) makes available to the User the information needed to demonstrate compliance with Article 28 GDPR and allows audits, on at least 14 days' prior notice, at the User's expense and without disrupting the Service Provider's operations; (g) notifies the User of a personal data breach concerning the entrusted data without undue delay, no later than 48 hours after becoming aware of it.
  4. The User gives general authorisation for the Service Provider to use the sub-processors listed in § 6 of the Privacy Policy. The Service Provider announces any intended change or addition of a sub-processor by updating the Privacy Policy and — for Users with an active Subscription — by email at least 14 days in advance; within that period the User may object and, if the objection is not accepted, terminate the contract with immediate effect.
  5. Data is transferred to third countries only using the mechanisms referred to in Chapter V GDPR, as set out in the Privacy Policy.

§ 10Termination of the contract and Account suspension

  1. The User may terminate the contract for the Service on the FREE Plan at any time, without giving reasons, with immediate effect, by requesting deletion of the Account via the Dashboard (Account & security → “Request account deletion”) or at kontakt@leadscout.pl. The Service Provider deletes the Account without undue delay, no later than within 14 days. An active Subscription should be cancelled before the Account is deleted; otherwise the Service Provider cancels it with effect from the date of deletion.
  2. The Service Provider may terminate the contract with 30 days' notice for important reasons, such as permanently discontinuing the Service or a change in the law preventing its provision. In that case the Service Provider refunds a proportional part of the fee for the unused part of the Billing Period.
  3. The Service Provider may suspend the Account or terminate the contract with immediate effect if the User grossly or persistently breaches § 3(6) or § 6 of the Terms, and in the case of remediable breaches — if the User has not stopped them despite a request and a deadline of at least 7 days. The Service Provider informs the User of the reasons for the suspension at the Account email address; the User may appeal under § 8.
  4. The Service Provider may delete a FREE Plan Account that has not been signed into for 36 months, after notifying the User by email at least 30 days in advance.
  5. Before terminating the contract, the User may export the Analysis history to a CSV file. After the Account is deleted, data is deleted in accordance with the Privacy Policy, except for data whose retention is required by law.

§ 11Changes to the Service and the Terms

  1. The Service Provider may make changes to the Service that are necessary to keep it in conformity with the contract, secure or compliant with the law, as well as development changes. A change to the Service for Consumers and Sole Traders with Consumer Rights that is not necessary to maintain conformity is permitted only under Chapter 5b of the Consumer Rights Act — at no extra cost to the User and with clear information about the change; if the change significantly and negatively affects access to or use of the Service, the User may terminate the contract within 30 days of the change or of being informed of it, whichever is later.
  2. The Service Provider may amend the Terms for important reasons, namely: (a) a change in the law or its interpretation by courts or authorities; (b) a change in the scope, functionality or method of providing the Service; (c) a change to the Price List or billing model; (d) the need to prevent abuse or ensure security; (e) a change in the details of the Service Provider or its subcontractors.
  3. The Service Provider informs Users about changes to the Terms by publishing the new version on leadscout.pl and by email to the Account email address at least 14 days before they take effect. A User who does not accept the changes may terminate the contract with immediate effect before that date at no cost; in the case of an active Subscription, the Service Provider then refunds a proportional part of the fee for the unused part of the Billing Period.
  4. Contracts concluded before the changes take effect are governed by the previous version of the Terms until the changes take effect.

§ 12Final provisions

  1. The contract is concluded in Polish; this English translation is provided for convenience. The contract is governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded by provisions that cannot be derogated from by agreement under the law of the country of their habitual residence.
  2. Disputes with Businesses are resolved by the common court having jurisdiction over the Service Provider's place of business. Disputes with Consumers and Sole Traders with Consumer Rights are resolved by the courts having jurisdiction under the applicable law.
  3. Matters not governed by the Terms are subject to the Polish Civil Code, the Act on the provision of electronic services, the Consumer Rights Act, the Electronic Communications Law and the GDPR.
  4. If any provision of the Terms proves invalid or ineffective, the remaining provisions remain in force. The Terms do not exclude or limit the rights of Consumers and Sole Traders with Consumer Rights under mandatory law; in case of conflict, those provisions prevail.
  5. The Service Provider does not apply a code of good practice within the meaning of the Polish Act on counteracting unfair market practices.
  6. Version 3.4 of the Terms applies from 15 October 2026 to Users who concluded a contract from that date, and to Users who concluded a contract earlier — from 29 October 2026. Until then, such Users may use SMTP/IMAP Mailboxes, A/B tests, Mailbox rotation, Prospecting, the CRM, yearly Subscriptions and Top-ups under version 3.4 if they choose to; otherwise the version that has applied to them so far continues to apply. Prices of Subscriptions concluded before 15 October 2026 do not change without the prior notice referred to in § 4.
